All customers should agree on all the terms and condition prior to their signup to any of the hosting plan mentioned on GibbonHosting.co.uk website. You shall agree to use only properly licenses third party software in connection with your use of our services

Security Interest :
Transmission, storage, or presentation of any information, data or material in violation of any United Kingdom law is prohibited. Engage in any activity that is, or appears to be, an attempt to gain unauthorized access to a remote system or network, or to gain information that could later be used to assist in gaining unauthorized access to a remote system or network, such as port scanning, dictionary attacks, Denial of Service attacks, server/service hijacking, etc.
Engage in any of the foregoing activities using the service of another provider, but channeling such activities through a Gibbon Hosting account or remailer, or using a Gibbon Hosting account as a mail drop for responses to UCE, or hosting a website that is advertised via UCE that originates from a non-redundanthost.com-connected source, or otherwise requiring return transit through Gibbon Hosting's internet backbone.
Falsify or "spoof" user information provided to Gibbon Hosting or to other users of the Service, and for handling all complaints and trouble reports made by its own customers and authorized users.

Copywright Act :
Any illegal use of the name of GibbonHosting.co.uk without permission of Management is not allowed. Copyrighted / obscene or any unauthorized material will not be allowed. We are not responsible in case of any consequences that are faced due to use of these materials. In this situation, we reserve complete authority to provide your information upon request to any legal representative or authority.
Any exploitation of resources that is displayed on this website is strictly prohibited and is a copywrited content which belongs to GibbonHosting.co.uk at its sole and absolute discretion.
Strict legal actions will be taken in the case of fraud attempts by any unauthorized an anonymous users/visitors.

Invoices / Payments : All plans are inclusive of value added taxes, any additional changes/charges in the plans/pricing can take place without any prior notice. All payment are accepted in form of Credit Cards, Debit Cards, paypal, and Wire / Bank Transfer.
Refunds wihin 30 days in any situation will not include 3rd Party software Charges such as cPanel / Plesk Charges. i.e. you are only liable to receive refund for the hosting package and not for the control panel as this is charged to us by the software company itself. The non-refundable's include cPanel VPS License, Plesk Licenses, Virtuozzo, SSL Certificates and Site Builder.
Appropriate reason should be provided in order to claim refunds from bodhost.com. If in case, you fail to do so. We reserve the rights to refuse / cancel or suspend service to your account. If the cancellation request is received within six to zero days before the renewal date, this cancellation request will be effective on the following billing cycle and charges for the current month will apply.
Any payments through check will take upto five days to clear. Following there will be a verification process to confirm the genuinity of the customer and thereafter the account information will be provided to you.

Email Services : You shall not engage in any unsolicited email practices at any domain hosted in our server or parked on our DNS servers. You are NOT allowed to use the services for chain letter, junk mail, spamming, or any other use of distribution list to any person who has not given permission to be included in such of process. Use the SMTP services of a third party for the purposes of relaying or sending electronic mail messages without the express permission of that third party.
Host a publicly-accessible "open relay" SMTP or anonymous remailer service for any purpose, cause, or reason.

Server Abuse :
Use the Service in violation or contravention of the Communications Act of 1934, as amended by the Telecommunications Act of 1996, or any other applicable law, regulation, order or other governmental directive, or abuse or fraudulently use the Service in any way not specifically set forth above.
If customer is notified by GibbonHosting.co.uk's Abuse Response Team, via e-mail or the Customer discovers on their own or through any other means, that the Customer themselves or any third party under Customers control of a violation of this AUP, the Customer will take whatever steps are necessary to stop such activity, and prevent repeat violations by the offending entity. If not, GibbonHosting.co.uk is entitled to suspend/terminate the customers account immediately. Server abuse in any situation is not allowed. If any threats are shown for this record. The hosting account will be suspended or terminated without any refund. You are NOT allowed to use this server's disk space nor it's bandwidth to distribute, electronically transmit or display any materials which: violate any countries laws or regulations; infringe on any intellectual property rights (e.g. copyright, trademark, patent or other proprietary rights); are threatening or harassing; are discriminatory based on gender, race and/or age; are consist of any viruses or other computer programming defects which result in damage to our server or any third party.
The customer will respond to all violations reported within 1 (one) business day of the violation being reported, and will have put a stop to the activity within 2 (two) business days of the violation first being reported.
Any interference with other's services, host or network is strictly prohibited. Users who violate systems or network security may incur criminal or civil liability.
Any information that is provided through Gibbon Hosting through any communicational means not to raise any disputes against www.GibbonHosting.co.uk nor do he /she initiate any legal proceedings with respect to the same.

Backup Options :
In case of Backups, we do not provide daily backups at client's end. The customer will require to maintain a regular backup for his services or purchase additional backup Services from GibbonHosting.co.uk. If you would like to know the prices for our backup plans, you can contact our Sales Department.

Bandwidth Exceeds :
In case of Bandwidth exceeds. A notification email will be sent to the customer. If the customer required additional bandwidth, he will require to purchase additional bandwidth or upgrade his current hosting account.

Domain Registerations / Renewals :
GibbonHosting.co.uk is a web hosting provider and not a domain Registrar. However, we can transfer the domain name through Name Servers. Also please make a note, that we do register domain names for you and process in the transfers. We are liable to charge registration or transfer charges to you. If you wish to display your information on the whois records. You can contact us any point of time and we will guide you further.
